POSH Policy Formulation & Implementation: Collaborate with HR, and IC members to draft, review, and revise the POSH policy, ensuring compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. Ensure proper communication and dissemination of the policy across all levels of the organization. Sexual Harassment Complaint Handling & Redressal: Actively participate in IC investigations, ensuring a neutral, unbiased, and confidential approach. Guide IC members in conducting fair hearings, evidence evaluation, and fact-finding to ensure proper redressal. Assist in conducting conciliation processes where required, ensuring that all resolutions align with POSH Act guidelines. Handle inquiries efficiently, ensuring a fair, unbiased, and confidential process, including evidence evaluation, witness examination, and fact-finding, while upholding due process and ensuring compliance with legal standards. IC Meetings & Governance: Attend and facilitate Internal Committee (IC) meetings, ensuring regular discussions on POSH compliance, case progress, policy reviews, and preventive measures. Monitor and strengthen IC governance to improve the effectiveness of workplace safety mechanisms. Compliance Documentation & Reports: Prepare Minutes of Meetings (MoM) for IC discussions, ensuring accurate documentation of case proceedings, decisions, and recommendations. Draft and submit the Annual POSH Compliance Report to the District Officer, as mandated under the POSH Act. Assist in preparing IC Inquiry reports, inquiry findings, and disciplinary recommendations. Collaboration with Leadership & HR: Work closely with senior management, HR, and legal teams to embed POSH and DEI policies into corporate governance. Assist in designing inclusive workplace strategies that align with global best practices in harassment prevention and gender equity.
Summoning the Complainant & Respondent Individually: Ensure both parties appear before the Internal Committee (IC) one by one for examination, maintaining confidentiality and a neutral stance throughout the proceedings. Examination Under Oath: Conduct examinations of both parties under oath, ensuring that their statements are recorded truthfully. The IC must provide equal opportunities for both the complainant and the respondent to present their versions of the incident. Summoning Witnesses & Documents for Fact-Finding: The IC has the authority to summon witnesses and request documentary evidence, emails, CCTV footage, or any other relevant materials to establish facts. Recording Statements & Obtaining Signatures: The statements of all individuals appearing before the IC, including the complainant, respondent, and witnesses, are to be documented accurately, signed by the respective individuals, and maintained as official records. This ensures adherence to due process and evidentiary integrity in the investigation.
