eLearnPOSH for Microsoft Teams

Terms of Use

These Terms of Use govern your access to and use of the eLearnPOSH app for Microsoft Teams (the “App”). The App delivers learning-related notifications from the eLearnPOSH platform inside Microsoft Teams. By installing or using the App, you agree to these Terms.

1. About the App

The App is a Microsoft Teams integration published by Succeed Technologies that delivers learning-related notifications from the eLearnPOSH learning platform, including course assignment notices, completion reminders, and related alerts, and may provide links back to the eLearnPOSH learning portal.

The App is not a standalone learning management system. Full learning content, progress tracking, certificates, and administration remain in eLearnPOSH (for example, https://courses.elearnposh.com).

2. Eligibility and Organizational Accounts

An active eLearnPOSH organization account is required to use the App.

Your organization’s HR, learning, compliance, or IT administrator must:

• Hold a valid eLearnPOSH subscription or service agreement
• Connect Microsoft Teams to eLearnPOSH through the admin configuration
• Authorize required Microsoft permissions for your Microsoft 365 tenant

Individual learners typically use the App only after their organization has completed setup.

3. License to Use the App

Subject to these Terms and your organization’s agreement with Succeed Technologies, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App within Microsoft Teams solely for your organization’s legitimate learning and compliance purposes.

You may not:

• Copy, modify, reverse engineer, or create derivative works of the App, except where allowed by law
• Use the App to violate any law, Microsoft Teams policies, or third-party rights
• Attempt to bypass security, authentication, or access controls
• Resell, sublicense, or provide the App as a standalone service to third parties

4. Microsoft Teams and Microsoft Services

The App runs inside Microsoft Teams and uses Microsoft Online Services such as Microsoft Entra ID (Azure AD), Microsoft Graph, and Azure Bot Service / Bot Framework.

Your use of Microsoft Teams and related Microsoft services is also subject to:

• Microsoft’s terms with your organization
• Microsoft’s privacy statement and Teams policies

We are not responsible for Microsoft Teams availability, outages, or changes made by Microsoft that affect the App.

5. Accounts, Access, and Administrator Responsibilities

Your organization is responsible for:

• Managing Microsoft 365 and eLearnPOSH user access
• Obtaining any required employee or learner notices and consents
• Ensuring accurate user identity mapping between Microsoft accounts and eLearnPOSH accounts
• Configuring and maintaining the Teams–eLearnPOSH connection

You are responsible for activity under accounts you control.

6. Data and Privacy

Use of the App involves processing of certain Microsoft identity and Teams-related data needed to deliver notifications (for example, tenant ID, user identifiers, display name, email/UPN where available, conversation references, and notification content).

By using the App, you acknowledge that privacy practices may also be governed by your organization’s agreement with Succeed Technologies and applicable data protection laws.

7. Notifications and Communications

The App may send messages and Adaptive Cards in Microsoft Teams related to assigned training, reminders, and service notices. These communications are part of the eLearnPOSH service your organization has enabled and are not unsolicited marketing.

8. Acceptable Use

You agree not to use the App to:

• Send unlawful, harmful, or abusive content
• Interfere with other users or the integrity of the service
• Probe, scan, or attack our systems or Microsoft systems
• Misrepresent identity or affiliation

We may suspend or terminate access for violations of these Terms or security risk.

9. Intellectual Property

eLearnPOSH, Succeed Technologies branding, course content, software, and related materials remain the property of Succeed Technologies or its licensors. These Terms do not transfer ownership of any intellectual property to you.

Microsoft, Microsoft Teams, and related names are trademarks of Microsoft Corporation. Use of Microsoft products is subject to Microsoft’s terms.

10. Third-Party Services

The App may interoperate with Microsoft services and your organization’s eLearnPOSH portal. We are not responsible for third-party services we do not control, including Microsoft Online Services.

11. Service Availability and Changes

We aim to keep the App available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change as Microsoft Teams APIs and our platform evolve.

We may update, suspend, or discontinue the App or features with notice where reasonably practicable.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Succeed Technologies and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from use of the App.

Our total aggregate liability arising out of or relating to the App will not exceed the fees paid by your organization to Succeed Technologies for the eLearnPOSH services giving rise to the claim during the twelve (12) months before the claim, or such other amount required by your master service agreement if one exists.

14. Indemnity

You agree to indemnify and hold harmless Succeed Technologies from claims arising out of your misuse of the App, violation of these Terms, or violation of applicable law, except to the extent caused by our gross negligence or willful misconduct.

15. Termination

These Terms apply while you use the App. Your organization or you may stop using the App at any time by uninstalling it and/or disconnecting Teams integration in eLearnPOSH admin settings.

We may suspend or terminate access if you breach these Terms, if required by law, or if Microsoft or your organization revokes necessary permissions.

Provisions that by nature should survive (including intellectual property, disclaimer, limitation of liability, and indemnity) will survive termination.

16. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the App after changes become effective constitutes acceptance of the updated Terms, unless applicable law requires otherwise.

17. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless your organization’s written agreement with Succeed Technologies specifies otherwise.
